Terms of Service — Promptly

1. Agreement

By creating an account or using Promptly (the "Service"), you agree to these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

2. The Service

Promptly provides AI-powered phone agents that answer inbound calls, place outbound calls, transcribe conversations, schedule appointments, and surface analytics. Features may evolve over time.

3. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.

4. Acceptable use

No illegal, harmful, harassing, or deceptive calls.
No use that violates telemarketing laws (e.g., TCPA, DNC lists) without proper consent.
No attempts to reverse engineer, disrupt, or overload the Service.
Comply with all applicable call-recording and privacy laws in your jurisdiction.

5. Customer data

You retain ownership of the data you submit. You grant Promptly a limited license to process it solely to provide and improve the Service, as described in our Privacy Policy.

6. AI output

AI-generated transcripts, summaries, and responses may contain errors. You are responsible for reviewing outputs before relying on them for material business decisions.

7. Fees & billing

Paid plans renew automatically until cancelled. Usage-based charges (e.g., minutes, calls) are billed in arrears. Fees are non-refundable except where required by law.

8. Termination

You may cancel anytime from your account settings. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, Promptly's aggregate liability arising from the Service will not exceed the amounts you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

11. Changes

We may update these Terms. Material changes will be announced in-app or via email and take effect on the date posted.
